TERMS & CONDITIONS
1. BOOKINGS & PAYMENTS
A booking with Five Automotive Ltd is confirmed once payment (deposit or full balance) has been received. Prices are agreed in advance and are non-negotiable once a booking is confirmed.
2. CANCELLATIONS, RESCHEDULING & WEATHER
Cancellations made within 48 hours of the scheduled shoot may result in loss of deposit.
Rescheduling is subject to availability.
Five Automotive Ltd reserves the right to reschedule due to adverse weather, illness, equipment failure, or circumstances beyond our control.
Weather Conditions
Where weather significantly affects the quality, safety, or outcome of a shoot, Five Automotive Ltd may recommend rescheduling to achieve the best results.
3. DELIVERABLES & TURNAROUND
PHOTOGRAPHY
Edited photographs will be delivered digitally via Pixieset.
Typical delivery time for photography is 24–48 hours, unless otherwise agreed in writing.
VIDEO / FILM
Edited video content will be delivered digitally.
Typical turnaround for video is up to 7 days, depending on project scope and current workload.
Larger or more complex video projects may require additional time; this will be communicated where possible.
DELIVERY ESTIMATES
All delivery times are estimates. Five Automotive Ltd will aim to meet stated timeframes; however, delays may occur due to workload, unforeseen circumstances, or technical issues.
PRIORITY DELIVERY
Rush or priority delivery may be available subject to availability and may incur an additional fee. Delivery times will be confirmed in writing before work begins.
4. CREATIVE CONTROL, EDITING & REVISIONS
Editing style, colour grading, pacing, and final output remain at the creative discretion of Five Automotive Ltd, unless otherwise agreed in writing.
Personal Clients
- Editing and colour grading services include one (1) round of revisions, unless otherwise agreed.
- Additional revisions may incur an extra charge.
- Revision requests must align with the originally agreed brief.
Business / Commercial Clients
- Editing and colour grading services include up to two (2) rounds of revisions, unless otherwise agreed in writing.
- Revisions must relate to the original project brief and creative direction.
- Additional revisions beyond the included allowance may be charged at an agreed rate.
General Revisions
Requests outside the original brief, or changes made after final approval, may be treated as a new edit and quoted separately.
All revision terms will be discussed and agreed at the time of contract.
5. USAGE RIGHTS & COPYRIGHT
General
Unless otherwise agreed in writing, Five Automotive Ltd retains full copyright and intellectual property rights to all photographs, video footage, and edited content.
Any transfer, licence, or alteration of usage rights must be agreed in writing and confirmed by a signed agreement.
Personal Clients
- Copyright remains with Five Automotive Ltd unless otherwise agreed in writing.
- Personal clients are granted a non-transferable, non-commercial licence to use final delivered content for personal use only.
- Content must not be altered, resold, sublicensed, or used for commercial purposes without written consent.
Business / Commercial Clients
- Copyright ownership and usage rights are determined by the terms set out in the signed contract.
- Unless explicitly stated otherwise, copyright remains with Five Automotive Ltd, with the client granted a licence for agreed commercial use.
- Any buyout, exclusivity, or copyright transfer must be clearly defined in writing and signed by both parties.
No copyright or usage rights are granted without a signed agreement. Verbal agreements do not override written terms.
6. COMMERCIAL VIDEO LICENSING
Unless otherwise agreed in writing, video content produced by Five Automotive Ltd is licensed for personal or internal business use only.
Commercial usage includes (but is not limited to):
- Paid advertising (online or broadcast)
- Brand or sponsor campaigns
- Sponsored social media content
- Product launches
- Third-party promotion
- Resale or redistribution
Any commercial usage beyond the agreed scope requires a separate commercial licence and may incur additional fees. Licensing terms will be agreed in writing prior to content delivery.
7. BRAND & SPONSOR USAGE
Where photography or video content includes:
- Sponsors
- Brand partners
- Paid collaborations
- Logos or product placement
The client is responsible for confirming they have permission to feature such brands.
Five Automotive Ltd must be informed in advance if content is intended for sponsor, brand, or commercial partner use.
Unauthorised brand or sponsor usage outside the agreed licence is prohibited without written consent.
8. PORTFOLIO, PROMOTION & CREDIT
Unless otherwise agreed in writing, Five Automotive Ltd reserves the right to use photographs and video content for portfolio, website, social media, and promotional purposes.
Where possible, credit to Five Automotive Ltd is appreciated when content is published online.
Five Automotive Ltd may repost client-shared content for promotional use.
Clients may request content not be used publicly at any time.
9. EVENT FILMING & PHOTOGRAPHY CONSENT
At events, car meets, shows, or public gatherings, photography and filming may capture attendees, vehicles, and members of the public.
Event organisers are responsible for:
- Informing attendees that photography and filming will take place
- Obtaining any required permissions or releases
By attending an event where Five Automotive Ltd is providing media coverage, individuals acknowledge that:
- They may appear in photographs or video footage
- Content may be used for promotional, editorial, or portfolio purposes
Individuals who do not wish to be filmed or photographed should make themselves known at the event, and reasonable efforts will be made to accommodate requests.
10. DATA STORAGE
Final delivered files are archived for a limited time. Clients are responsible for downloading and backing up all content once delivery has been completed. Five Automotive Ltd is not responsible for data loss once files have been delivered.
11. CLIENT RESPONSIBILITY
Clients are responsible for ensuring vehicles, locations, and participants are prepared, safe, and legally permitted for photography or filming. Delays caused by the client may affect deliverables or turnaround times.
12. LIABILITY
All reasonable care is taken during shoots. Five Automotive Ltd is not responsible for damage to vehicles, property, or individuals during a shoot unless caused by proven negligence.
13. FORCE MAJEURE
Five Automotive Ltd shall not be held liable for failure to perform services due to circumstances beyond reasonable control, including but not limited to extreme weather, accidents, illness, equipment failure, or government restrictions.
14. ACCEPTANCE
By booking a service with Five Automotive Ltd, the client confirms they have read, understood, and agreed to these Terms & Conditions. Where applicable, acceptance is confirmed by signed agreement.
